MAINLAND RESIDENTS WHO ACQUIRE TAIWAN RESIDENCY CAN INHERIT AS TAIWAN RESIDENTS
To protect the legitimate interests of heirs resi-dent in mainland China, the Statute Governing Relations Between the People of the Taiwan Area and the Mainland Area provides for a pe-riod of three years, running from the date of the deceased's death, for mainland heirs to claim their right of inheritance. However, in a recent ruling, the MOF states that if a mainland heir acquires Taiwan residency before the period for claiming inheritance has expired, he may inherit the deceased's property according to this status, and is not then subject to the restrictions of the statute on inheritance of property in Taiwan by mainland residents.
