EFFECTS OF FOREIGN TRADE LAW AMENDMENT ON HIGH-TECH EXPORTS

To protect national security, strengthen control over the exportation and final destination of strategic high technology goods, and facilitate the importation of high-technology goods, on 30 November 1999 the Legislative Yuan passed amendments to the Foreign Trade Law.

The amendments added the provisions that without prior authorization, strategic high-technology goods shall not be exported to restricted areas, nor pass through border controls, be transshipped or placed in bonded warehouses at ROC commercial ports.

In addition to the original criminal penalties for violators of up to two years' imprisonment and/or fines of up to NT$300,000, new administrative penalties are imposed whereby a company may be prohibited from importing or exporting goods for one to twelve months, or in severe cases struck off the Board of Foreign Trade's registry of importers and exporters and fined NT$30,000 to NT$300,000.
