"REGULATIONS GOVERNING REVIEW OF APPLICATIONS FOR RESERVATION OF CORPORATE NAMES AND BUSINESS SCOPES" AND "REGULATIONS GOVERNING COLLECTION OF COMPANY REGISTRATION FEES" AMENDED

The Ministry of Economic of Affairs (MOEA) amended Article 11 of the "Regulations Governing Review of Applications for Reservation of Corporate Names and Business Scopes" and the "Regulations Governing Collection of Company Registration Fees" on 1 July 2009, respectively. The major amendments are as follows:
     
l The business scope of a company should be registered in accordance with the business items and business codes of the "Codes of Business Items of Companies and Firms" promulgated by the MOEA. It is not allowed to merely register a catch-all business item, heavily, "All business items that are not prohibited or restricted by law, except those that are subject to special approval", as its business scope.
     
l In order to improve the e-government policy and to enhance the convenience for people to apply for reservation of the company's name and business scope through internet, it stipulate the registration fee for the applications apply through internet. In addition, it also stipulate the registration fee for the establishment of a branch office or representative office in Taiwan by a Mainland China business entity in order to conform to the "Act Governing Relations between Peoples of the Taiwan Area and the Mainland Area". Furthermore, to facilitate the collaboration of the inspection of the city planning department, the construction department, the fire department, and the sanitation department, and the examination for the qualification to participate in government purchase after the abolishment of the Unification System for Issuance of Business Licenses, the registration fee can be exempted for the first application for amendment to additional business scope (excluding those busies item required special permit) by those companies which only registered the catch all business scope or both catch all and other specified business.
