ABOLISHMENT OF THE UNIFICATION SYSTEM FOR ISSUANCE OF BUSINESS LICENSES

The Executive Yuan announced that the Unification System for Issuance of Business Licenses would be abolished on 13 April 2009.

Afterwords, a business operator should apply for company or business registration, or amendment to its registration in accordance with the Company Act or the Business Registration Act, respectively. It will no longer has to file an application with the local government in the place where it is located for issuance or amendment to its Business License. The approval letter issued by the competent authorities for company registration or business registration will serve as evidence to prove its registration. However, (1) the zoning restriction on respective business will remain unchanged, and (2) an application should be filed with the tax authorities in the place where the company or business is located for business registration or amendment (the form of the relevant applications is still under drafting). In order to conform to the amendments, the company registration authority will send a copy of its approval letter to the tax department, the city planning department, the construction department, the fire department, and the sanitation department for them to enforce their respective regulations.

In addition, the particulars of all company/business registrations will be posted on the competent authority's public website in accordance with Paragraph 2, Article 393 of the Company Act and Paragraph 2, Article 26 of the Business Registration Act. Any person may have access to the information..
