MAXIMUM NT$500,000 FINE FOR HARASSMENT PREVENTION LAPSES



To assure employees' right to work by preventing the occurrence of sexual harassment in the workplace, Article 13 Paragraph 1 of the Gender Equality in Employment Act (GEEA) requires any employer with 30 or more employees set up sexual harassment prevention measures, as well as rules for complaints and disciplinary action, and to display these rules publicly in the workplace.  Article 13 Paragraph 2 further requires that if an employer becomes aware of sexual harassment (as defined in Article 12), it should immediately take effective action to correct and redress the situation.
 
Amendments to the GEEA that were recently enacted by the Legislative Yuan have increased the penalties for employers that fail to comply with the above requirements to NT$100,000–NT$500,000, from the previous NT$10,000–NT$100,000.  This is expected to better prompt employers to prevent sexual harassment in the workplace.
