DEPOSITORY FOR BIOLOGICAL MATERIAL PATENTS
The Patent Act provides that when deposition of biological material is required in support of an invention patent application that relates to bio-logical material or the use of biological material, before filing the patent application, the applicant has to deposit the concerned biological material with a depository within Taiwan designated by the Intellectual Property Office. When filing a patent application with the IPO, the applicant has to submit documents issued by the depository, evidencing such deposit.
Pursuant to Article 30 of the Patent Act and Ar-ticle 16 of the Administrative Procedures Act, the IPO has appointed the Food Industry Re-search and Development Institute (FIRDI) as a depository effective during the time period from 1 January to 31 December 2007.
