DRAFT AMENDMENTS TO FOOD SANITATION ACT

In order to cope with the increasingly compli-cated food sanitation issues, enforce effective control of food sanitation, curb the spreading of unlawful food advertisements, and protect public health and consumers, a draft amendment to the Food Sanitation Act has been adopted on No-vember 30, 2005 by Executive Yuan. Key points of the draft are summarized as follows:

The period for advertising agencies to keep the relevant information of the principals of the foods-related advertisements is extended so as to facilitate tracing of the sources of unlawful advertising materials and relevant unlawful foods, and to improve source control. (Article 19).

The scope of the authority of the local com-petent authorities to order suspension of the food production and supply operations and the attachment of products is expanded so as to control the sale of questionable foods, and to protect the health and safety of the public. (Article 24).

Persons violating certain provisions of the Act may be ordered to recall the food products from the markets, and be prohibited from continuing the sale of such food products prior to the satisfactory rectification of the defects. (Article 29).

The amounts of fines for violations having significant prejudice to the food sanitation and safety control practices are raised. (Articles 31 and 33).
