COMPANY REGISTRATION MATTERS DELEGATED TO PROVINCIAL / MUNICIPAL GOVERNMENT AUTHORITIES
On 30 December 1998, the Ministry of Economic Affairs (MOEA) announced a partial amendment to the Interim Measures Governing Work Entrusted or Delegated by the MOEA to the Provincial or Municipal Governments and Their Departments or Bureaus. Article 4 of the amendment provides that with the exception of recognition of foreign companies and matters concerning companies within export processing zones and science-based industrial parks, company registration matters for companies with paid-in capital of less than NT$100 million should be entrusted to the Department or Bureau of Reconstruction of the provincial or municipal governments in accordance with the relevant provisions of the Company Law. Therefore, in cases of investment by overseas Chinese or foreign nationals where the company's paid-in capital is less than NT$100 million, company registration matters should now (effective as of 1 January 1999) be handled by the aforesaid department/bureaus rather than by the MOEA Commerce Department as was previously the case.
