CONTROL MEASURES IN SOIL AND GROUNDWATER POLLU-TION CONTROL ZONES

The Environmental Protection Administration recently announced its Regulations Governing Control Measures in Soil and Groundwater Pol-lution Control Zones. Under the regulations, local competent authorities will announce vari-ous kinds of pollution control zones (special soil pollution control zones, general soil pollution control zones, special groundwater pollution control zones, and general groundwater pollution control zones) in accordance with the route of transmission of pollutants in a polluted site, and the degree of hazard. The following actions are prohibited in all such pollution control zones:

  • Depositing pollutants into the soil;


  • Discharging wastewater or effluent into groundwater; and


  • Discharging wastewater or effluent into the soil.


  • No person may enter a special soil pollution control zone without prior permission of the lo-cal competent authority. The following land use activities are prohibited within such zone:

  • Construction, extension, alteration or repair of buildings or facilities not required for the execution of a pollution remediation plan or pollution control plan; and


  • Environmental impact assessment activities.

    Use of groundwater in a special groundwater pollution control zone is prohibited. The man-ager of a general groundwater pollution control zone must quarterly report the concentration of pollutants in wells within the zone to the local competent authority.
