The Legislative Yuan has adopted an amend-ment to the Waste Disposal Law. The main points are as follows:
When the competent authorities plans the provision of waste removal facilities, if the use of land for this purpose requires changes in urban planning, such changes may be made in accordance with actual conditions by acceler-ated procedures under the Urban Planning Law. If such use requires the rezoning of non-urban land, land may be allocated, leased or sold to the promoters of the facility without being subject to the restrictions of the Land Law (which provides that the sale, encum-brance, or lease for more than ten years of public land requires the consent of the relevant elected assembly).
The review procedures for waste disposal plans are simplified. An entity wishing to engage in waste removal and disposal opera-tions may apply to an agency authorised by the EPA for the issuance of a public or private waste management organization license. In order to speed up the review procedure, in the future the EPA will set up specialist agencies at science-based industrial parks, export processing zones and industrial zones to re-view factories' waste disposal plans and issue permits.
The competent authorities may enter the oper-ating premises of relevant enterprises to in-spect at-source waste management and recy-cling operations.
Fines for failure to dispose of waste are in-creased by three to five times.
