PCC ANNOUNCED GUIDELINES FOR TIME EXTENSION AND COST INCREASES DUE TO WORKING HOURS ADJUST-MENTS



Article 30 of the Labor Standards Law was amended on 19 July 2000 to reduce employees' maximum working hours to 84 hours in two weeks. In response to the amendment, the Public Construction Commission (PCC) announced on 9 August 2001 that where the terms of a pro-curement contract spans the amendment's effec-tive date of 1 January 2001, and the contractor needs to extend the working period or incur ad-ditional costs as a result of the change, the con-tractor may apply with the procuring agency for relief. Agencies should apply the following guidelines when handling such applications:

  • The contractor should state the number of ad-ditional critical path days required to complete the project, starting from the date when the new working hours rules came into effect, as a basis for consultation. The method of calcu-lation should be stated. If a cost increase is necessary as a result, the supplier should state the additional personnel resources needed from the date the new rules were implemented, and on that basis calculate the possible in-creased cost related to such extra personnel, as a basis for consultation. It should also be noted whether personnel costs are charged per job, per month or per hour.


  • The above rules do not apply to contracts tendered for and awarded after the revised working hours rules were announced on 19 July 2000.
