PROPOSED CHANGES TO PROTECTION OF COMPUTER PROGRAMS
The Executive Yuan approved the text of a draft amendment to the Copyright Law, intended to extend the protection of economic rights in computer programs to 50 years after the death of the author, where the author is a natural person. This will bring the law into line with Article 10 Paragraph 1 of the WTO TRIPS Agreement. The proposed amendment deletes the reference to computer programs in Article 34 Paragraph 1 of the law, with the effect that the general pro-visions of Articles 30 to 33, providing for copy-right protection to continue for 50 years after the death of an author, will also apply to works in the form of computer programs. The draft amend-ment will be sent to the Legislative Yuan for enactment.
